Who these terms are between

These terms are between Kotka and you: your team, and each person on it who uses Kotka. Kotka is operated by kotka.io.

Early access

Kotka is in early access. Features, limits and prices may change, and features may be added or removed, while Kotka is being built. Using Kotka means you accept that it is not yet a finished product.

Accounts

Each person who uses Kotka has their own login. Do not share a login between people. If you own the team, you are responsible for what the people you add to it do with Kotka.

How you may use Kotka data

Use Kotka data for your own internal business: prospecting, research, and enriching records you already hold.

What you may not do

• Sell, resell, license, share or otherwise make Kotka data available to anyone outside your team.
• Use Kotka data to build, train or improve a database, list, product or service that competes with Kotka.
• Copy the database in bulk, or use bots, scripts, crawlers, scrapers or any other automated means to access Kotka, except features Kotka provides for that purpose.
• Get around credits, export allowances, reading limits, seat counts or any other limit, including by sharing logins or opening extra accounts.
• Use Kotka data to contact people in ways that break anti-spam or privacy law (CASL, CAN-SPAM, and any other law that applies to you).

Limits and enforcement

Kotka sets usage limits, including credits, export allowances and daily reading limits, and may change them. Kotka may slow, suspend or close an account that breaks these terms. Where the breach is bulk copying or resale, Kotka may do this without notice.

Data you exported during your subscription

You may keep using data you exported while subscribed for your own internal business after your subscription ends, subject to the section above on what you may not do. Those restrictions survive your subscription ending.

Plans, billing and cancellation

• Plans are billed in advance, monthly or yearly.
• Cancelling takes effect at the end of the period you already paid for.
• Plan credits stay usable until then, and expire when the period ends.
• Purchased credits expire at the end of the monthly cycle they were bought in.
• Kotka does not refund partial periods.
• Organization is sold yearly only.

Data accuracy

Kotka works to keep its records accurate and current, but does not promise that any record is complete, current or correct. Report an error with the link on the record.

People in Kotka’s data

Kotka holds business contact information about people in their professional roles, such as their name, job title, employer and work email address. Anyone can ask to see, correct or remove the information Kotka holds about them by writing to hello@kotka.io. Kotka responds within 45 days.

If a person you reached through Kotka asks you to stop contacting them, you must stop, and remove them from your own lists and systems.

AI features

Some Kotka features use artificial intelligence, such as describing your ideal customer in your own words. Text you enter into these features is sent to Anthropic, Kotka’s AI provider, to produce a result. Kotka does not use what you enter to train AI models.

AI results can be wrong. Check them before you rely on them. Do not enter sensitive personal information into these features.

Service providers

Kotka uses other companies to run the service. They handle your account information only to provide their service to Kotka:

• Vercel, Railway and Supabase, for hosting, databases and sign-in.
• Stripe, for payments. Kotka never sees or stores your full card number.
• Postmark, for the email Kotka sends you.
• Anthropic, for AI features.
• Google, if you choose to sign in with Google.

Indemnity

You will defend Kotka against, and cover Kotka’s losses from, any claim that arises from your use of Kotka data in breach of these terms or the law, including how you contact the people in it.

Disclaimers and limitation of liability

The service and Kotka data are provided as is and as available, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement.

Kotka is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data. Kotka’s total liability is limited to the fees you paid in the 12 months before the claim.

Some places do not allow these limits. Where they do not, the limits apply as far as the law allows.

Changes to these terms

Kotka posts changes here and updates the date. Material changes are emailed to team owners before they take effect.

Governing law

These terms are governed by the laws of the Province of British Columbia.
